About
Nicole M. Aloise is an Attorney at Barket Epstein Kearon Aldea & LoTurco, LLP, where she represents individuals and organizations in complex criminal defense, government investigations, and high-exposure litigation. With nearly two decades of courtroom experience, she brings a measured, strategic approach to defending clients facing serious state and federal scrutiny.
Before entering private practice, Ms. Aloise served as a Senior Assistant District Attorney in both Queens County and Nassau County. She prosecuted homicides, gang enterprise cases, firearm offenses, narcotics trafficking, robbery, kidnapping and other major violent felonies from investigation through trial and verdict. Her experience includes extensive motion practice involving suppression hearings and constitutional challenges, grand jury presentations and the examination and cross-examination of forensic experts, medical examiners, firearm specialists and law enforcement witnesses. She has built – and now carefully analyzes – cases grounded in digital evidence, surveillance footage, fingerprint analysis, and DNA proof, often in complex matters lacking eyewitness testimony.
Ms. Aloise pioneered the use of curated video-compilation evidence to present detailed timelines to juries and was the first prosecutor in New York City to secure convictions based primarily on officer-worn body camera footage. She also identified and charged witness intimidation offenses during trial through strategic review of recorded inmate calls.
Her commitment to integrity in the justice system led her to conduct post-arrest investigations that resulted in the exoneration of two wrongfully identified individuals in Queens and one in Nassau County. While serving at the Nassau County District Attorney’s Office, Ms. Aloise worked very closely with federal prosecutors in large-scale firearms and enterprise investigations, contributing to a 59-count federal racketeering indictment involving conspiracy to commit murder, attempted murder, firearm offenses and fraud. She also secured convictions in fentanyl-related “death by dealer” prosecutions requiring coordination among local and federal authorities.
In 2025, Ms. Aloise earned the Democratic nomination for Nassau County District Attorney in a county-wide election, receiving bipartisan endorsements from law enforcement and labor organizations. That experience enhances her ability to guide clients through matters involving governmental investigation, reputational risk and public scrutiny.
At Barket Epstein, Ms. Aloise will be able to apply her prosecutorial insight to anticipate government strategy, evaluate evidentiary strength, and develop disciplined, forward-looking defense strategies at every stage of the criminal process. She will bring her professionalism, careful preparation, strategic clarity and a steadfast commitment to protecting her clients’ rights to the firm.
