What is Embezzlement?
Embezzlement is a white-collar crime that involves the misappropriation or theft of funds entrusted to someone in a position of trust. This often occurs in the workplace, where an employee unlawfully takes or converts assets for personal gain. Embezzlement charges can range from simple theft to complex financial schemes, and the penalties can be severe.
Embezzlement Penalties in New York
Embezzlement can be charged as either a misdemeanor or a felony, with the severity of the charge depending on the amount of money or value of property involved.
If the value of the embezzled property is less than $1,000, it is typically charged as petit larceny, which is a Class A misdemeanor. The maximum penalty for petit larceny is up to one year in jail.
If the value of the embezzled property exceeds $1,000, it can be charged as grand larceny, which is a felony offense. The severity of the grand larceny charge depends on the value of the property as follows:
Property valued between $1,000 and $3,000. This is a Class E felony with a maximum penalty of up to four years in prison.
Property valued between $3,000 and $50,000. This is a Class D felony with a maximum penalty of up to seven years in prison.
Property valued between $50,000 and $1 million. This is a Class C felony with a maximum penalty of up to 15 years in prison.
Lastly, property valued at more than $1 million. This is a Class B felony with a maximum penalty of up to 25 years in prison.
Keep in mind, if the offense occurred in multiple states or involved parties or victims in more than one state, embezzlement could be charged as a federal crime.
