The New York State Department of Motor Vehicles has revised its rules and regulations which will have a dramatic impact and cause many more motorists to lose their New York State Driver's license.
These changes include:
● Assignment of 11 points for any violation involving operation of a motor vehicle while such person’s license is suspended or revoked;
● Assignment of 8 points for passing a stopped school bus and speeding in a work zone;
● Assignment of 5 points for speed contest or racing, failure to exercise due care, facilitating aggravated unlicensed operation, and leaving the scene of a personal injury accident;
● Expansion of the points accumulation period from 18 to 24 months;
● Substantially increased negative units and an extended lookback period for relicensing determinations;
● More restrictive relicensing thresholds, including denials based on accumulated negative units; and
● Broader avenues to lifetime or extended administrative revocation for repeat alcohol or drug-related driving incidents.
These changes will have a substantial and immediate impact on plea negotiations and post-conviction advocacy.
