Felony Attorney in New York
Team-Based Defense for Serious New York Charges
A felony accusation changes the stakes of a criminal case quickly. The case may involve grand jury proceedings, prosecution in a superior court, and sentencing rules that depend on the exact offense, criminal history, and other statutory factors.
At Barket Epstein Kearon Aldea & LoTurco, LLP, our criminal defense team has represented more than 1,000 clients in matters ranging from DWI to homicide. Multiple attorneys may contribute to the investigation, evidence review, procedural analysis, and strategic decisions that shape a serious criminal case.
Our attorneys bring more than 200 years of combined legal experience, including prior service as prosecutors, public defenders, and judges. Hon. David J. Ayres previously served as a Nassau County Court Judge and Acting Supreme Court Justice. These different backgrounds help us evaluate a case from the perspectives of the defense, prosecution, and court.
We represent clients facing New York State felony allegations in Nassau County, Suffolk County, Manhattan, and surrounding areas.

What Makes a Charge a Felony in New York?
Under New York Penal Law, a felony is an offense for which a sentence of more than one year of imprisonment may be imposed. Felonies are classified from Class A, the most serious category, through Class E.
The class matters, but it does not determine the full sentencing exposure by itself. The specific offense, whether it is designated as a violent felony or another special category, prior convictions, and other sentencing statutes can change the applicable range.
Felony charges can arise from many types of allegations, including:
- Homicide and serious assault
- Robbery and burglary
- Grand larceny, fraud, forgery, and identity theft
- Drug possession, sale, and trafficking
- Firearm and weapon offenses
- Sex offenses
- Certain repeat DWI and vehicular offenses
Our broader criminal defense practice includes state and federal matters. This page focuses on felony charges prosecuted under New York State law.
How a New York Felony Case Can Begin
A felony case may begin with an arrest, a warrant, or, in some lower-level felony matters, an appearance ticket when New York law permits one.
The first court appearance is the arraignment. The accused is advised of the charges, counsel addresses immediate legal issues, and the court considers release conditions when applicable.
The court that handles the early stages depends on where the case arose. In Nassau County, District Court has preliminary jurisdiction over felony cases. In Suffolk County, District Courts and Town or Village Courts can handle preliminary felony proceedings depending on location. In New York City, Criminal Court generally handles felony cases before indictment.
Because local procedure varies, identifying the court and procedural posture is one of the first steps in our review.
