A decision this week by a state appellate court in Albany will send the re-trial of Calvin Harris from Tioga to Schoharie County, a move following arguments from Harris’ defense lawyers that the extensive publicity the case has received has rendered it impossible to pick a fair jury in its original venue.
In the past 12 years, Harris has become a “household name” due to the level of news coverage his case has amassed, defense lawyer Donna Aldea of Barket Epstein Kearon Aldea & LoTurco, LLP in Garden City, NY, argued in a 30-page motion to change venue. At this point, she said, a trial in Tioga County makes his conviction “a foregone conclusion.”
“This decision is the first step toward getting Cal a fair trial. They will decide based upon the evidence heard in court…and Cal has not yet had that opportunity,” Aldea said.
